Children who were conceived during the time their parents were legally married may be entitled to support from the person listed on the birth certificate—because, in some cases, the court will assume he is the biological father.
 
However, proving paternity is a far different process for parents who were not legally married at the time a child was born in California. This process requires signing forms either in or outside of the hospital following the birth, among other steps.

It Can Identify Possible Paternity Fraud

When a mother falsely identifies a man to be the child’s biological father on the birth certificate and does so knowing he is not, this is a violation of paternity law in California. Men who believe they are victims of paternity fraud must provide evidence where the mother states in some way that she knew the man named on the birth certificate was not the child’s father.
 
A man named on a birth certificate as the child’s father who knows he is a victim of paternity fraud may be obligated to undergo testing to determine paternity. He may also need to find the biological father. Although not always the case, some courts have been known to overturn child support cases for men who successfully proved paternity fraud.

The parental names on a birth certificate indicate that those persons possess parental rights and responsibilities. These include requesting visitation and custody orders, child care costs, and child support. However, the document itself also outlines the rights of the child. Without producing this important piece of identification, children cannot obtain other necessary items they will need later in life, such as a Social Security card and passport.
